====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 13-06-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is seeking regular bail in connection with Gardanibagh P.S. Case No.178 of 2017 punishable for offence under Section 379 of the Indian Penal Code.

It is submitted on behalf of the petitioner that he has been taken on remand in the present case only on mere suspicion when he was arrested in connection with Sikandra P.S. Case No.94 of 2017. Learned counsel submits that the stolen motorcycle was recovered from the possession of the co-accused Sanjeev Kumar who has been granted bail by the learned coordinate bench of this Court vide order dated 20.04.2018 in Cr. Misc. No.22916 of 2018. It is further submitted that in Sikandra P.S. Case No.94 of 2017 the petitioner has been granted bail.

Patna High Court Cr.Misc. No.32520 of 2018 (2) dt.13-06-2018 Learned A.P.P. for the State is present.

Considering the facts and circumstances of the case wherein the stolen motorcycle is said to have been recovered from the possession of the co-accused, let the petitioner, named above, be released on bail on furnishing bail bond of 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge XIV-cum-A.C.J.M, Patna in connection with Gardanibagh P.S. Case No. 178 of 2017, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure and that (1) One of the bailers must be a family member of the petitioner having no criminal antecedents and (2) the petitioner must co-operate in the trial and he must attend court whenever the date is fixed by the court below. In case of his failure to attend court without any cogent or proper reason, his bail bonds shall automatically stand cancelled. (Rajeev Ranjan Prasad, J) Arvind/Manoj/Amjad U T
