The petitioner apprehends his arrest in connection with Excise Case No. 434 of 2017 arising out of Korma P.S. Case No. 43/2015 for the offence punishable under Sections 272 and 273 of the Indian Penal Code and Section 47(A) of the Excise Act.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. Nothing has been recovered from the conscious of this petitioner. The alleged recovery has been made from the bank of Tati River.

Considering the facts and circumstances of the case, let the above named, petitioner in the event of surrender within

Patna High Court CR. MISC. No.15941 of 2019(3) dt.22-05-2019 2/2 a period of four weeks be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District and Sessions Judge, Sheikhpura in connection with Excise Case No. 434 of 2017 arising out of Korma P.S. Case No. 43/2015 subject to the conditions laid down under Section 438(2) of the Cr.P.C.
