The petitioner, in the present case, is seeking regular bail in connection with Baisi P.S. Case No. 102 of 2018, registered for offences alleged under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Amendment Act, 2018.

It is submitted on behalf of the petitioner that petitioner happens to be a passenger of the vehicle. There is recovery of 125 litres of illicit liquor from the vehicle in question. It is submitted that in course of inspection of the vehicle, the driver fled away. This petitioner was not aware of the fact that there was any illicit liquor in the vehicle but was arrested.

Considering the facts and circumstances of the case whereunder the petitioner is said to be a passenger of the vehicle and has no criminal antecedents, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge - II-cumSpecial Judge (Excise Act), Purnea, in connection with Special Case No. 404 of 2018 arising out of Baisi P.S.
