JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-05-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of bail in a case registered for the offence punishable under sections 302, 307 and other allied sections of the Indian Penal Code. As per prosecution case, on the point of grazing of paddy field, free fight took place between the parties as a result of which both parties sustained injuries. Later on during course of treatment, two persons namely, Rojadin Mian and Babudin Mian died.
It is submitted on behalf of petitioner that general and omnibus allegation has been levelled against 10 named and 20 unknown persons. No specific overt-act has been alleged against the petitioner. There is case and counter case and similarly situated co-accused has been granted bail by this court.
Patna High Court CR. MISC. No.16559 of 2022(2) dt.19-05-2022 2/2 Petitioner is in custody since 3.1.2022.
Learned counsel for the State opposes the prayer for bail.
Considering the facts and circumstances of the case, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Ms Anupama, Judicial Magistrate Ist Class, Chapra, Saran/ concerned court in Mashrak P.S. Case no. 408/2020.
