The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 363, 365, 366(A), 341, 323, 504 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that on 06.10.2021 at 2.00 P.M., informant's minor daughter had left the house, but did not return on which, search was made, but she was not located. It is further alleged that petitioner a week back had threatened the informant of kidnapping his daughter at an auto stand.

The learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.17143 of 2022(3) dt.26-09-2022 2/2 petitioner has been falsely implicated in the present. It is next submitted that the victim came back and her statement was recorded under Section 164 of the Cr.P.C. wherein she has not supported the prosecution case.

Learned A.P.P. opposes the bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Bypass P. S. Case No.401 of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
