Petitioner seeks regular bail in connection with Kasim Bazar PS Case No. 263/2020 registered for the offences punishable under Sections 25 (1-A)/25 (1-AA)/25 (1-B)a/26(i) (ii)/35 of the Arms Act dated 25.09.2020.

This is the third attempt for grant of regular bail on behalf of the petitioner inasmuch as earlier two bail applications of the petitioner got dismissed consecutively vide orders dated 31.01.2022 passed in Cr. Misc. No. 41189/2021 and vide order dated 19.10.2022 passed in Cr. Misc. No. 48528/2022 respectively. This Court, while rejecting the second application for bail vide order dated 19.10.2022 passed in Cr. Misc. No.

Patna High Court CR. MISC. No.23581 of 2023(2) dt.19-04-2023 2/2 48528/2022, had granted the liberty to the petitioner to renew his prayer for bail after framing of charge.

Learned counsel for the petitioner submits that uptil now, the charge has not been framed and the petitioner is in custody since 25.09.2020.

Regards being had to the submissions made by the parties and taking into consideration the fact that the petitioner was given liberty to renew his prayer for bail after framing of charge and the same has not been framed, I am not inclined to grant regular bail to the petitioner. The prayer for bail is again rejected.
