JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-02-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

It is informed that petitioner Nos. 2, 3 & 4 have already been arrested and accordingly, their prayer for anticipatory bail stands dismissed being infructuous.

Petitioner Nos. 1 & 5 apprehend their arrest in connection with of Mansi P.S. Case No. 248 2013 registered under Sections-147, 148, 149, 379 & 426 of the Indian Penal Code and Section-27 of the Arms Act.

So far as aforesaid petitioner Nos. 1 & 5 are concerned; no specific overt act has been attributed against them

Patna High Court Cr.Misc. No.32132 of 2014 (2) dt.03-02-2015 2/2 and moreover, it is submitted on behalf of the petitioners that petitioners were making protest against land acquisition and a writ in respect of above-said land acquisition is also pending before this court.

Considering the above-said facts and circumstances as well as submission of the parties, let petitioner Nos. 1 & 5, namely, Kamal Kishore Yadav and Guddu Yadav the event of arrest or surrender in the court below within four weeks from today, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Mansi P.S. Case No. 248 2013 to the satisfaction of Chief Judicial Magistrate, Khagaria subject to conditions as laid down u/S 438(2) of the Cr. P.C.
