The petitioner seeks bail in Pakaridayal P.S. Case No. 16 of 2017 registered under Section 387 and 120 B of the Indian Penal Code.
As per the prosecution case, one Shiv Shankar Sharma claiming to be President of New Ranvir Sena demanded extortion of Rs.30 lacs from the informant on his mobile phone under threat of dire consequence.
It is submitted by learned counsel for the petitioner that the petitioner is neither named in the F.I.R. nor he was apprehended on the spot. He has no concern with the said Shiv Shankar Sharma and has been falsely implicated in this case. He has not made any demand of extortion from the informant though
Patna High Court Cr.Misc. No.39663 of 2017 (02) dt.21-08-2017 2/ 2 seven criminal cases are pending against him but he has been enlarged on bail in five cases. He has been languishing in custody since 11.05.2017.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 5th Additional Chief Judicial Magistrate, Motihari, East Champaran in connection with Pakaridayal P.S.
