JUSTICE SHAILENDRA SINGH ORAL ORDER 11-04-2025 Heard Mr. Kamal Kumar Sinha, learned counsel for the petitioner, Mr. Vijay Kumar, learned counsel for the informant and Mr. Anil Kumar Singh No. 1, learned APP for the State.
2. The petitioner seeks regular bail in connection with Sono P.S. Case No. 309 of 2024 dated 21.09.2024 registered for the offence(s) punishable under Sections 103(1), 61(2), 238 and 3(5) of the B.N.S and Section 27 of the Arms Act
3. As per the prosecution story, on 29.09.2024 at about 6:00-6:30 P.M., petitioner along with co-accused Gulshan Kumar Singh came to the informant's house and asked his father to accompany them for a panchayat meeting. As they approached the Panchayat Bhawan, petitioner suddenly pulled out a pistol and fired at the informant's father with the intent to kill. Luckily the shot did not hit him. However, co-accused
Patna High Court CR. MISC. No.16713 of 2025(2) dt.11-04-2025 2/3 Gulshan Kumar Singh also fired at that time, the bullet struck the informant's father in the chest and he was declared dead by the doctor.

The main submissions advanced by petitioner's counsel are that as per the FIR, the bullet which caused firearm injury to the chest of the deceased is not alleged to have been fired by this petitioner and that firing as per the allegation was made by the co-accused Gulshan Kumar Singh though this petitioner is alleged to have fired at the deceased but the same missed as per the prosecution story and the FIR was registered one day after the alleged occurrence. It is further submitted that the petitioner has fair and clean antecedent and he himself surrendered on 01.10.2024 before the trial court since then he has been languishing in jail.

On the other hand, learned counsel appearing for the informant has vehemently opposed the bail prayer of the petitioner and submits that there is serious allegation against this petitioner and after the occurrence, he has been continuously threatening the prosecution party and making pressure to withdraw the case and in this regard, a separate case bearing Sono P.S. Case No. 356 of 2024 has been lodged and it was the petitioner who took the deceased from his house in the name of

6. Considering the seriousness of the allegation appearing against this petitioner as pointed out by the informant's counsel and also appearing from the FIR, this court is not inclined to release this petitioner on bail at this stage.
