JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-07-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Learned counsel for the petitioners submits that petitioner No. 1, namely, Dhamu Sheikh @ Firoz Alam @ S.K. Dhamu has already been arrested and accordingly, this petition in respect of above-said petitioner No. 1 stands dismissed being infructuous.
So far as remaining two petitioners are concerned; they apprehend their arrest in connection with Belthar P.S. Case No. 05 of 2015 registered under Section-302 & other minor sections of the Indian Penal Code.
Patna High Court Cr.Misc. No.24677 of 2015 (2) dt.13-07-2015 2/2 Petitioners are very much named in the first information report with allegation that they along with others, assaulted the deceased and got ran jeep on his person. Considering the facts and circumstances of the case as well as submission of the parties, I am not inclined to grant privilege of anticipatory bail to the petitioner Nos. 2 & 3 namely, S.K. Lalu @ Javed Alam @ S.K. Javed and Lal Sheikh @ Lal Sheikh Roy bail and accordingly, their prayer for anticipatory bail in connection with Belthar P.S. Case No. 05 of 2015 pending in the court of Judicial Magistrate-Ist Class/concerned court Begusarai stands rejected.
