JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-09-2017 The petitioner seeks regular bail in connection with Pirasi P.S. Case No. 22 of 2017, registered for offences punishable under Sections 302, 201 and 34 of Indian Penal Code. Allegation against the petitioner that he along with others killed the son of the informant.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case only on the basis of suspicion and there is no eye-witness of the occurrence. Further from perusal of F.I.R itself it will appear that the parties were on inimical terms and due to which whole family members have been made accused in this case. It has also been submitted that if the allegations is believed to be true, no specific allegation has been made against the petitioner. Petitioner has no criminal antecedent and has been in judicial custody since 19.07.2017.

Having heard both sides, considering the fact and circumstances of the case, this application is disposed of with direction to the court below that after submission of charge-sheet, he will verify the submission of learned counsel for the petitioner that save and except suspicion, there is nothing against the petitioner and if it is so, he will release the petitioner on bail to his own satisfaction, otherwise he is free to pass any order as he deems fit and proper.
