The petitioner is languishing in custody since 15.1.2019 in a case registered for the offences punishable under Section 290 of the I.P.C. and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The prosecution case is that from a motorcycle, 38 litres country made liquor was recovered, leading to registration of FIR against unknown. Subsequently, the petitioner was arrested on 15.1.2019.

It is submitted by learned counsel for the petitioner that the petitioner has no concern with the seized motorcycle and only on the basis of suspicion, the petitioner has been roped in the present case as he was earlier also remanded in three other cases.

Patna High Court CR. MISC. No.15817 of 2019(2) dt.14-03-2019 2/2 Learned APP submits that the recovery has been made from the alleged motorcycle and the petitioner was arrested on his confession that the recovered liquor was being transported illegally.

Considering the nature of accusation and the period under custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Khajekalan P.S. Case No.89 of 2018.
