Mr.Vinay Krishna Tripthy ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-07-2019 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

Petitioner has approached this Court for a direction to the CBSE to make necessary correction in the name of mother of the student who passed CBSE examination from Army School, Danapur.

The name of mother in the record of school was mentioned as Pinki Devi. Now prayer is made in the writ

Patna High Court CWJC No.6335 of 2019(3) dt.05-07-2019 2/3 application for direction to the respondents to correct the name to the extent that instead of Pinki Devi it should be Pinki Kumari.

Mr. Vinay Kirshna Tripathy, learned counsel appearing on behalf of the CBSE submits that CBSE can only rectify mistake if there is error in the record of CBSE contrary to the record maintained by the school. In the school register and the record, the name of the mother is mentioned as Pinki Devi and such application for correction was rejected by the CBSE as the CBSE did not find any error in the record of CBSE.

Considering the nature of correction sought by the petitioner in the present writ application i.e. instead of Pinki Devi correction as to Pinki Kumari, the Court is inclined to direct the CBSE to correct the record provided necessary affidavit is filed by the petitioner before the 1st Class Magistrate and a copy of the same may place before the school as well as CBSE declaring therein that the name of mother of Puja Kumari Gupta is Pinki Kumari instead of Pinki Devi.

Necessary correction may be carried out by the school as well as CBSE from the date of receipt/production of a copy of this order.
