JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 11-02-2015 Heard counsel fort the petitioners and the State. The two petitioners herein are amongst ten persons named in the FIR vide Pandarak P.S. case No. 61 of 2013 instituted under sections 144 and 379 IPC. They seek anticipatory bail. The allegation is that all the accused persons forcibly harvested the crops from the field of the informant. The contention of the petitioner is that they are Bataidar(s) and lay their claim over the produce/crops. One of the co accused(s) of the present case has since been released on anticipatory bail vide order dated 12.12.2014 passed in Cr. Misc. No. 29234 of 2014, a web copy whereof has been handed in by the counsel for the petitioners which is taken on record and

Counsel for the State points out that there is criminal antecedent against the petitioners.

Considering the facts and circumstances of the case, in the event of arrest/surrender within four weeks from today, petitioners above named shall be released on bail on furnishing bail bonds of Rs. 10,000/- each, with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate, Barh, Patna in connection with Pandarak P.S. Case No. 61 of 2013 subject to the conditions that one of the bailors shall be their own/close family members. The petitioners shall appear in person on each date once the charges are framed. In case of default in doing so the court below shall cancel their bail bonds. During the subsistency of this privilege of bail if the petitioners are found involved in any criminal case of serious nature the same shall entail cancellation of their bail bonds.
