JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 21-08-2017 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in Pakaridayal P.S. Case No. 15 of 2017 registered under Section 387 and 120-B of the Indian Penal Code.

As per the prosecution case, one Shiv Shankar Sharma claiming to be New President of Ranvir Sena demanded extortion of Rs.30 lacs from the informant on his mobile phone under the threat of dire consequence.

It is submitted by the learned counsel for the petitioner that the petitioner is neither named in the F.I.R. nor he was apprehended on the spot. He has no concern with the said Shiv Shankar Sharma and has falsely been implicated in this case.

Patna High Court Cr.Misc. No.39685 of 2017 (2) dt.21-08-2017 He has not made any demand of extortion from the informant. Though seven criminal cases are pending against him but he has been enlarged on bail in five cases. He has been languishing in custody since 01.05.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 5th Additional Chief Judicial Magistrate, Motihari, East Champaran in connection with Pakaridayal P.S.
