The petitioner seeks bail in connection with Darbhanga (Jainagar) Rail P.S. Case No. 319 of 2018 instituted for the offence under Section(s) 370/376 of the Indian Penal Code and Sections 4/6/8 of POCSO Act and Sections 9/10/11 of Child Marriage Prohibition Act, 2006.

Learned counsel for petitioner has stated that petitioner is father of the victim girl.

In the written report, informant has alleged that her father has performed her marriage with one Ram Awatar against her wishes and Ram Awatar has established physical relationship with her. The girl has given her statement under

Patna High Court CR. MISC. No.19644 of 2019(2) dt.01-04-2019 2/2 Section 164 Cr.P.C., which is annexed as Annexure-2 to bail petition, wherein, she has stated that her father has solemnized her marriage with Ram Awatar who is aged about 35-40 years. Learned counsel for petitioner submits that compromise has now taken place and compromise petition has also been filed in the court below which is annexed as Annexure-4.

Petitioner is in custody since 22.12.2018 having no criminal antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I cum Special Judge, Madhubani in connection with Darbhanga (Jainagar) Rail P.S. Case No. 319 of 2018 corresponding to G.R. No. 108 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/mu keshU T
