2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 317 (5) of the BNS and Sections 8, 17 (a), 18 (a), 8 (c) and 21 (b) of the NDPS Act.

3. The case of the prosecution is that from the joint house, altogether 10 grams of opium, some cash and mobile were recovered.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that nothing has been recovered from the possession of this petitioner whereas recovery has been made from a joint house.

Tausif has already been granted bail by a co-ordinate Bench of this Court vide order dated 14.10.2025 passed in Cr. Misc. No. 73026 of 2025. The case of this petitioner stands on better footing. It is further submitted that the alleged quantity of contraband is more than the small quantity but less than the commercial quantity. Moreover, the petitioner is languishing in judicial custody since 15.12.2025 having no criminal antecedent.

Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sadar P.S. Case No. 380 of 2025 arising out of Special NDPS Case No. 249 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (NDPS Act), Purnea.
