The petitioner seeks bail in connection with N.D.P.S. Case No. 01 of 2017, arising out of Barhara (Krishnagarh O.P.) P.S. Case No. 11 of 2017 dated 13.01.2017 instituted for the offences under Sections 20(B)/22 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

On secret information, a marriage hall in village Manjhauli was raided and on breaking open the lock of one of the rooms, about 61⁄2 kgs. of decomposed Ganja was recovered. The FIR indicates that the father of the petitioner had communicated to the police party that the keys of that room always remained with the petitioner who had gone to Varanasi at the time of the raid. Patna High Court Cr.Misc. No.47968 of 2017 (3) dt.02-01-2018 the storage of the narcotics would have been known to the petitioner, his father, in all probability, would not have made such statement.

Considering the aforestated facts and the period of custody of the petitioner which is from 09.08.2017, this Court is inclined to grant bail to him. While saying so this Court has also taken note that the petitioner does not have any criminal antecedent.

In the facts and circumstances, the petitioner above named is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Bhojpur at Ara in connection with N.D.P.S. Case No. 01 of 2017, arising out of Barhara (Krishnagarh O.P.) P.S. Case No. 11 of 2017.
