The petitioner is in custody since 04.01.2018 in connection with Sonepur (Hajipur) Rail P.S. Case No.02 of 2018, registered under Section 08/2022 of Narcotic Drugs Psychotropic Substance Act, 1985 (hereinafter referred as N.D.P.S. Act). The learned counsel for the petitioner submits that 8.5 k.g. ganja were recovered from platform No.3 by the police personnel station and only on suspicion, the petitioner was taken into custody. It is submitted that neither was the same bag found in the possession of the petitioner nor was he carrying the same and only because he was nearby the bags, he was taken into custody.
