1. It is submitted by learned counsel for the appellant that the instant appeal has wrongly been filed before this court and the same ought to have been filed before the Children Court, hence the appellant wants to withdraw this appeal with liberty to file his appeal before appropriate forum and the period which has spent in this appeal may be excluded while computing the limitation period.

2. Having considered the above submission and prayer, the instant appeal stands dismissed as withdrawn with the aforesaid liberty and the period which the appellant spent in filing this appeal shall not be taken into consideration by the court concerned in respect of the limitation period of the appeal which is to be filed by the appellant.
