2. The petitioner apprehends arrest in connection with Teghra P.S. Case No. 242 of 2023 dated 03.08.2023, instituted for the offence punishable under Sections 448, 341, 323, 353, 504, 506, 307, 427/34 of the Indian Penal Code.
3. As per allegation, the petitioner along with other coaccused persons entered into the office of the informant and started assaulting him. They also dismantled the articles of the office and threatened him to kill.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is submitted that F.I.R. has been lodged against named accused persons including the petitioner. It is submitted that the main allegation is on Mohan Kumar and not on the petitioner. The said Mohan Kumar has been granted bail vide Criminal Miscellaneous
Patna High Court CR. MISC. No.18457 of 2024(2) dt.15-04-2024 2/2 No. 77439 of 2023 by a Co-ordinate Bench of this Court. It is also submitted that other named accused person, namely, Kunal has also been granted bail vide Criminal Miscellaneous No. 83086 of 2023 and Ramanuj Kumar @ Ramanuj Singh has been granted bail by a Co-ordinate Bench of this Court vide Criminal Miscellaneous No. 69071 of 2023. It is submitted that there is no specific allegation against the petitioner rather it is general and omnibus. Lastly, it has been submitted that he has no criminal antecedent.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner in connection with Teghra P.S. Case No. 242 of 2023, he shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai, subject to condition as laid down under Section 438(2) of the Cr.P.C..
