The petitioners apprehend their arrest in Hathauri P.S. Case No. 33 of 2014 registered under sections 147, 323, 504, 379 of the Indian Penal Code and 3(1)(X) of SC & ST Prevention of Atrocities Act.
The informant made allegation that while he was going to the house of Laxmi Sah his bicycle touched Raj Kishore and verbal altercation took place and on such Satish Singh @ Bablu Singh abused him by naming his cast and other accused persons dragged him to Hathauri Chauk. They abused and assaulted him with fist and slaps.
Learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.32840 of 2014 (2) dt.03-02-2015 2/2 the complainant is driver of Laxmi Sah. Meera Devi wife of Laxman Sah petitioner no.3 filed a complaint case against Laxmi Sah and others on 23rd September 2013. The present case is at the instance of Laxmi Sah. On perusal of record it appears that the informant has made very specific allegation against the petitioners that on account of some accident by bicycle all the accused persons abused the informant by naming his cast and dragged him to the Chauk. They also assaulted him with fist and slaps. Hence, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly the same is rejected.
