This application, for grant of anticipatory bail, arises out of Danapur Police Station Case No. 547 of 2017, disclosing offences under Sections 302, 120(B), 341, 323, 147, 148, 149 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner has submitted that there is general and omnibus allegation against this petitioner and no specific overt act is attributed to him. The main allegation of firing causing injury to the brother of the informant is attributed against Prem Ratan Rai and Arjun Rai. Moreover, co-accused, Devendra Narayan Singh and Sanjay @ Chunnu, have also been granted anticipatory bail by different co-ordinate
Patna High Court Cr.Misc. No.32725 of 2018 (2) dt.06-06-2018 Benches of this Court in Cr. Misc. No. 47168 of 2017 and Cr. Misc. No. 21626 of 2018. Hence, the petitioner deserves the privilege of anticipatory bail.
Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1, Danapur, Patna, in connection with Danapur Police Station Case No. 547 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
