JUSTICE SUDHIR SINGH ORAL ORDER 16-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in connection with Ara Muffasil P. S. Case no. 271 of 2014 instituted under Sections 147, 148, 149, 384, 385, 307. 325, 354, 354A, 379, 504 and 506 of the Indian Penal Code.
Allegation against the petitioner is that he demanded money and stopped the construction work of the informant. Further, petitioner assaulted the informant and other family members, made them injured and snatched golden chain and other articles from the female members of the house. It has been submitted on behalf of the petitioner that petitioner has got no criminal antecedent. There is case and counter case between the parties. The petitioner has been falsely implicated in this case due to land dispute between the parties. The injury report finds place at Annexure-3 to the present application indicating that injuries are simple in nature. On behalf of the State, it is submitted that the petitioner is

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara , in connection with Ara Muffasil P.S. Case no. 271 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) sudip/- U T
