2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 302, 304(B) and 34 of the Indian Penal Code.

3. The case of the prosecution is that the petitioner was married to Sanju Devi. It is further alleged that she was being subjected to cruelty and was being assaulted by her inlaws. On 28.08.2022, Sanju Devi gave information on mobile that her in-laws are abusing and assaulting her. On 29.08.2022 when the informant went to the matrimonial house of Sanju Devi and he found that the deceased was lying on the ground and there was mark of strangulation.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Learned counsel for the petitioner has submitted that the marriage was solemnized six years ago and prior to this occurrence, there has been no complain from the deceased against her in-laws. The deceased was blessed with two issues. It has also been submitted that there is allegation that the deceased has informed the informant that she was being assaulted by her in-laws but from perusal of the postmortem report, it transpires that only mark of strangulation was found over the neck and cause of the death is hypoxia and hemorrhage due to strangulation. Learned counsel has also submitted that the petitioner is suffering from severe heart disease and doctor has advised him for surgery. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 11.04.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named
