JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,353,427 and 504 of the Indian Penal Code.
The prosecution case is that on 26.12.2015 the informant being Circle Officer, was performing his duty in the office when the petitioner came and requested for sanction of map for construction commercial complex on his land. The informant suggested that the map can only be sanctioned after obtaining the report of revenue karmchari on the recommendation of the SDO but the petitioner got infuriated, tore the government records and gave life threatening to the informant.
It is submitted by the learned counsel for the petitioner
Patna High Court Cr.Misc. No.20159 of 2016 (2) dt.06-05-2016 2/2 that in fact the informant demanded illegal gratification for passing of the map, as a result the petitioner also filed Bidupur P.S. Case No. 534 of 2015.
Considering the nature of dispute, let the above named petitioner be released on provisional anticipatory bail for six months in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Bidupur P.S. Case No.533 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
The provisional bail of the petitioner will be confirmed by the learned court below after taking report from the concerned police station with regard to the good behaviour of the petitioner.
