The petitioner seeks bail in a case registered for the offence punishable under Section 25(1-b)a/26 of the Arms Act in connection with Jamui P.S. Case No. 406/2016. Allegation against the petitioner is of recovery of one country made pistol and cartridge.
Submission of the learned counsel for the petitioner is that as a matter of fact, altercation took place between the petitioner and one other person, for that a case has been lodged in Jamui Police Station and when the police, on information, raided the house of one Kailu Tanti, the petitioner was present there. From possession of the petitioner one country made pistol and
Patna High Court Cr.Misc. No.39711 of 2017 (3) dt.01-09-2017 2/2 cartridge were recovered. He was also remanded in two other cases. Prior to that, the petitioner had no criminal antecedent. Now, the petitioner has remained in custody for seven months. Heard learned Additional Public Prosecutor also. Having heard both sides, in view of the facts, stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S. Case No. 406/2016, subject to conditions that one of the bailors should be relative of the petitioner and another having sufficient immovable property within the jurisdiction of the court below.
