The petitioner is in custody in connection with Rajgir P.S. Case No. 88 of 2018 registered for the offence under Sections 30(a) of the Excise and Prohibition Act, 2016. Learned counsel for the petitioner submits that the alleged liquor was recovered from the house which is in joint possession of the petitioner and other brothers. Referring to paragraph No. 3, learned counsel submits that the petitioner has no criminal antecedent and the petitioner is in custody since 14.4.2018.

Considering the fact that the petitioner is in custody since 14.4.2018 and the liquor is alleged to have been recovered from a house which is in joint possession of the petitioner and
