ANSARI ORAL ORDER 24-06-2015 This is second application, made under Section 438 of the Code of Criminal Procedure, seeking pre-arrest bail by the petitioner, namely, Bhagya Narayan Bhagat, in connection with Complaint Case No.

C-2127 of under Sections 420/468/120B of the Indian Penal Code inasmuch as the petitioner's earlier application for anticipatory bail has already been rejected by order, dated 16.04.2015, passed in Cr.Misc.No. 38616 of 2014.

Heard Mr. Pramod Kumar Pandey, learned counsel for the petitioner, and Mr. A. Dayal, learned APP, appearing for the State. Because of the nature of incriminating materials available against the petitioner, this Court is of the view that in the facts and

Patna High Court Cr.Misc. No.24986 of 2015 (2) dt.24-06-2015 attending circumstances of the present case, the petitioner has not been able to make out any fresh ground calling for giving him benefit of pre-arrest bail.
