JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-09-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Koransarai P.S. Case no. 26 of 2017, registered under Sections 406 and 420 of the Indian Penal Code.

The accusation is that petitioners along with one unknown came at the door of the informant and stated that they will provide job to his son, if informant will provide Rs. Five lakhs to them. The informant made request to give the said amount in the installments and he gave Rs. 1,35,000/- to the petitioners, but job has not been provided to his son. On demand of money the petitioners did not give any heed on it.

Learned counsel for the petitioners submits that, in fact,

No.42485 of 2017 (2) dt.20-09-2017 2/2 the informant of the present case has taken loan of Rs. 1 lakh for doing business of stone chips and on demand of the said money, the informant managed to lodge the present case with false allegation for providing job to his son. The petitioners have no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Buxar in connection with Koransarai P.S. Case No. 26 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
