This is an application for grant of regular bail filed on behalf of the petitioner. Petitioner is in custody in connection with Nalanda PS Case No. 154 of 2018 for the alleged offence punishable under Sections 498(A), 380 read with Section 34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
Learned counsel representing the petitioner submits that offence under Section 498(A) IPC and Section 3 /4 of the Dowry Prohibition Act are not attracted as the marriage took place in the year 2008. Learned counsel further submits that the
Patna High Court CR. MISC. No.17838 of 2019(2) dt.26-03-2019 2/2 petitioner is the husband, marriage took place ten years back and he is ready to keep his wife with full honour and dignity. He also submits that petitioner has no criminal antecedent and has been languishing in jail since 16.01.2019. Considering the totality of the fact situation indicated hereinabove, this application is allowed. Accordingly, let the petitioner above-named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Nalanda PS Case No. 154 of 2018.
