JUSTICE SATYAVRAT VERMA ORAL ORDER 23-09-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 342, 323, 324, 307 and 34 of the Indian Penal Code. The informant alleges that his son and petitioner had gone to attend a marriage on 19.04.2019 on a motor cycle but his son did not return home, further at 1:00 am, petitioner informed him of an accident near petrol pump and that the victims were in a hospital, it is further alleged that the informant reached the place of occurrence and asked the petitioner about the accident on which he could not give any proper account of the incident thus the informant based on suspicion alleges that petitioner, in conspiracy, might have committed the occurrence.

No.17997 of 2022(2) dt.23-09-2022 2/3 Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is aged about 20 years and has been falsely implicated in the present case, it is next submitted that petitioner and the deceased were good friends and as such the deceased had accompanied him for attending the marriage but an accident took place on account of which he was admitted in hospital in a serious condition in I.C.U. where he died subsequently, it is further submitted that had the petitioner been involved in any manner in the occurrence then definitely he would not have informed the informant about the occurrence. Learned counsel next submits that from bare reading of the allegations as alleged in the FIR it would manifest that the same hinges around suspicion, it is next submitted that petitioner is a young boy and in the event, if on the basis of suspicion, he is sent to jail, then his entire career would get jeopardized.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on

No.17997 of 2022(2) dt.23-09-2022 3/3 anticipatory bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Saraiya P.S. Case No. 249 of 2019 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. with a further condition that one of the bailors of the petitioner shall be his father, Mahadeo Bhagat and the petitioner shall also co-operate in the investigation.
