JUSTICE MADHURESH PRASAD ORAL ORDER 06-11-2019 Counsel for the State relying upon averments made in para 6 of the counter affidavit filed on behalf of respondent Nos. 2 and 3 submits that the petitioner was given promotion from Junior Engineer to Assistant Engineer with retrospective effect i.e. 27.12.1998 under notification dated 11.9.1996. Consequential benefits/monetary benefits was also found due to the petitioner along with others by departmental letter contained in memo No. 3470 dated 26.9.1998.

That takes care of entitlement of the petitioner. The only issue which now remains is that entire monetary benefits on account of such decision has not been paid to the petitioner.

Since no adjudication remains in the instant proceeding, this Court would not keep the matter pending. The authorities should ensure that entire due and admissible financial benefits on account of communication dated 26.09.1998 taken note of hereinabove, and which remained unpaid, be paid to the petitioner. This Court also directs that authorities should give details of calculation showing all payments made under the various head as per entitlement in terms of decision taken note of hereinabove. Let entire exercise be completed by respondent No. 4 positively within a period of three months from the date of receipt/production of a copy of this order.

The writ petition stands disposed of.
