Petitioner seeks bail in a case registered for the offences punishable under Sections 394, 302, 120B of the Indian Penal Code and Sections 25(1-b)a/26/27/35 of the Arms Act. Co-accused Govind Paswan is said to have looted the Scorpio vehicle after causing firearm injury to the driver of the vehicle. Govind Paswan was apprehended along with a pistol and four live cartridges. Govind Paswan disclosed to the police that he had committed crime alleged with the help of his brother Sharwan Kumar. Considering the aforesaid material co-accused
Patna High Court CR. MISC. No.17092 of 2019(2) dt.29-04-2019 2/2 Radhe Shyam Sharma @ Radhe Sharma has been allowed bail by a Coordinate Bench of this Court vide order dated 15.02.2019 passed in Cr. Misc. No. 79388 of 2018 (Annexure2). Petitioner is in custody since 05.09.2018 and he has got no criminal antecedent.
Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S. Tr. No. 510 of 2018/403 of 2018 arising out of Barun Police Station Case No. 131 of 2018, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
