The petitioner is apprehending his arrest in connection with Chakia P.S. Case No. 56 of 2016 registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.
Learned counsel for the petitioner submits that no money has been given to the petitioner to deposit the amount in Rose Valley, Non-Banking. It is further submitted that in fact, the petitioner is a L.I.C. agent and he had been doing business only to sustain his family and the petitioner has been falsely implicated in the present case. It is further submitted that when the informant started harassing the petitioner, he had filed an
Patna High Court Cr.Misc. No.20982 of 2016 (4) dt.05-07-2016 2/2 informatory petition before the S.D.M. Chakia, West Champaran on 16.04.2015 itself stating that the informant was threatening and harassing him.
Considering the nature of allegation against the petitioner and that Annexure-2, which indicates that one Munna Kumar is the agent of the present informant, let the petitioner, above named, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Additional Chief Judicial Magistrate-13, Motihari, East Champaran in connection with Chakia P.S. Case No. 56 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Anjana Mishra, J) ajaypd./- U T
