Petitioner is in custody since 26.11.2019 and seeks bail in connection with Saharsa Sadar P. S. Case No.988 of 2016 registered for the offences punishable under Sections 304(B), 34 of the I.P.C.
The petitioner happens to be mother-in-law of the deceased and the impugned order goes to show that husband as well as some other in-laws of the deceased have already been granted privilege of bail by different Benches of this Court. Moreover, the first information report goes to show that omnibus allegation of pouring kerosene oil on the deceased has
Patna High Court CR. MISC. No.20446 of 2020(2) dt.24-07-2020 2/2 been levelled against petitioner and other co-accused. The F.I.R. does not contain the allegation of demand of dowry, but in spite of that the present case was lodged under Section 304-B/ 34 of the I.P.C.
Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Saharsa P.
