JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-03-2019 The petitioners seek bail in anticipation of their arrest in connection with Riga P.S. Case No. 300 of 2018, dated 10.10.2018, instituted for the offences under Sections 272, 273 and 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. 27 litres of liquor is said to have been recovered from a motorcycle which was found abandoned near Riga Railway Station. The petitioners, after seeing the police party, are said to have run away, leaving behind the motorcycle and the liquor.

The learned counsel for the petitioners has

Patna High Court CR. MISC. No.17823 of 2019(2) dt.28-03-2019 2/2 submitted that the motorcycle in question does not belong to the petitioners and they have falsely been implicated in this case.

There is no recovery from the possession of the petitioners and they have clean antecedents.

Considering the aforesaid facts, the petitioners above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-Cum-Special Judge, Excise Act, Sitamarhi, in connection with Riga P.S. Case No. 300 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
