The petitioners are in custody in connection with Birpur P.S. Case No. 85 of 2018 for the offence under Sections 30 and 32 of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioners submits that the petitioners have got no criminal antecedent and they are in custody since 14.02.2020. He further submits that in the instant case total 346.5 litres of foreign liquor was seized. He also submits that petitioner no.2 is aged about 70 years. He submitted that nothing was seized from the conscious possession of the petitioners.
