JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-05-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 353, 307, 332, 337, 427, 504 of the Indian Penal Code and under Sections 3⁄4 of Damage to Public Property Act. The prosecution case is that a mob of 100-150 persons blocked N.H.-77. The informant, being a police officer, made Sanha diary entry and sent information to his superior officers and reached to the spot and learnt that since Ajay Kumar, who was accused in Goraul P. S. case No. 334 of 2015, was killed, hence, the road was blocked. The mob pelted stones and made assault as a result whereof the police personnel received injuries.

No.20168 of 2016 (2) dt.06-05-2016 2/2 It is submitted by the learned counsel for the petitioners that petitioner No.1 is nephew of Ajay Kumar and petitioner No.2 is employee of petitioner No.1 hence, they have been roped in the present case. It is further submitted that since the mob was protesting against inaction of the police, the present case has been lodged. There is no specific accusation against the petitioners. Statement has been in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Vaishali at Hajipur in connection with Goraul P.S. Case No. 335 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
