The petitioner seeks bail in connection with Rosera P.S. Case no. 182 of 2017 registered for the offence punishable under Sections 8/20(b) ii (A) of Narcotic Drugs and Psychotropic Substance Act 1985 (NDPS).

68 grams ganja is said to have been recovered from the hut of the petitioner and he was apprehended by the police. It is submitted by the learned counsel for the petitioner that nothing incriminating article has been recovered from his conscious physical possession. As a matter of fact, the petitioner has been falsely implicated in the case as he failed to oblige the illegal demand of the police by planting the ganja in his

Patna High Court Cr.Misc. No.46101 of 2017 (2) dt.20-09-2017 hut. The said seized ganja is of small quantity. The petitioner has been languishing in custody since 20.7.2017.

Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned A.D.J.-1st-cumSpecial Judge, NDPS, Act Samastipur in connection with Rosera P.S. Case no. 182 of 2017.
