The petitioner seeks bail in a case registered under Sections 25(1-B)a, 25, 35 of the Arms Act and Sections 37(c) & 37(d) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

The prosecution case, in short, is that one country made pistol is recovered.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 25-01-2020. It is alleged that one country made pistol is recovered from the car in

Patna High Court CR. MISC. No.15296 of 2020(2) dt.03-03-2020 2/2 question. The petitioner and other accused persons are said to be found in drunken state. Nothing incriminating has been recovered from the conscious possession of the petitioner. The petitioner had no knowledge regarding the alleged incident. There is no compliance of Section 100 Cr.P.C. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Supaul in connection with Supaul P.S. Case No. 59 of 2020 (S.T. Excise 126 of 2020).
