The petitioner has preferred this application for grant of regular bail in a case registered under sections 409 and 120B of the Indian Penal Code.

As per the prosecution case, soon after the various home guards including the petitioner herein having joined the new place of posting, it was reported that various arms and ammunitions had disappeared. This included the rifle of the petitioner.

It is submitted by learned senior counsel appearing for the petitioner that the petitioner has been falsely implicated in the case. There is no basis nor evidence for the allegations levelled in the FIR to the effect that the arms and ammunitions

Patna High Court CR. MISC. No.27835 of 2021(3) dt.30-11-2021 2/2 may have been made to disappear for economic benefit. The petitioner is in custody since 25.12.2020 and has no criminal antecedent. Co-accused Ranjan Sah has been enlarged on bail vide order dated 24.9.2021 passed in Cr. Misc no. 24575 of 2021.

Heard learned APP for the State Having heard learned counsel for the parties and taking into consideration the facts of the case, the nature of allegation together with the petitioner having remained in custody for more than 11 months, the Court directs the petitioner to be enlarged on bail in connection with Rajpur P.S. Case no. 190 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M 1st Class, Bikramganj, District Rohtas.
