2. The petitioner has preferred this application for grant of regular bail in connection with Manuapool P.S. Case No. 30 of 2025 dated 05.02.2025 registered for the offences punishable under Sections 126(2)/76 of BNS, Sections 8/12 of POCSO Act and Section 37 of the Bihar Prohibition and Excise Act.
3. As per the prosecution case, the informant's daughter was grazing goats near the river in her village, in the meantime, the petitioner in drunken state came there and grabbed the arm of the informant's daughter with wrongful intention. Thereafter, the informant's daughter raised alarm upon which the petitioner tried
Patna High Court CR. MISC. No.15957 of 2025(2) dt.02-04-2025 2/2 to flee but was caught by the local people and handed to the patrolling team.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The name of the petitioner has transpired in this case merely on suspicion. It is further submitted that there is no eye-witness to the alleged occurrence. The petitioner has no concern with the alleged occurrence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 06.02.2025.
5. Learned A.P.P. for the State has opposed the bail petition of the petitioner and has supported the prosecution case.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, West Champaran in connection with Manuapool P.S. Case No. 30 of 2025.
7. The application stands allowed.
