JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-05-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,324,307,379,504 and 506/34 of the Indian Penal Code. It is alleged that the FIR named accused persons came armed with various weapons, started uprooting the Jiya trees when protest was made then co accused Ramtahal Yadav and Bharat Yadav inflicted injury with Farsa on the head and arm of the informant and co accused Shatrudhan Yadav assaulted with Farsa on the head of the informant but actual injury was caused on shoulder. He repeated the blow which caused injury on the back portion of the head of the informant. It is further alleged that when

Patna High Court Cr.Misc. No.21590 of 2015 (2) dt.20-05-2015 2/2 the younger brother of the informant Jay Kumar Yadav came to rescue he was being assaulted by the back portion of Bhala and lathi by the petitioners and others.

It is submitted by the learned counsel for the petitioners that injury report of Jay Kumar Yadav is not on record and there is no accusation against petitioners that they assaulted the informant. It is further submitted that the accusation has been levelled in the background of land dispute.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Madhepura in connection with Kumarkhand P.S. Case No. 157 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
