JUSTICE MOHIT KUMAR SHAH ORAL ORDER 16-09-2022 The present petition has been filed seeking the following reliefs :- "(i) For issuance of a writ in the nature of mandamus commanding and directing the respondents authorities especially the Circle Officer, Runnisaidpur to remove the encroachment from the Plot No. 873 under Khata no. 574 recorded as Sarv Sadharan road but in collusion with the Circle officer or local administration many of the persons have constructed pucca construction and encroached the road resulting that the villagers are everyday facing trouble and can't play their vehicle

(ii) For further direction to the respondent District Magistrate to take appropriate action against the Circle officer concerned who in collusion with the encroachers has allowed to make pucca construction and despite of repeated representation not taking any action against the persons concerned.

(iii) For further direction to the respondent authorities to dispose of the representation of the petitioner by reasoned and speaking order within time frame."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Runnisaidpur, District-Sitamarhi i.e. the respondent no. 5 for redressal of his aforesaid grievances. Liberty so sought, is granted.

It is needless to state that in case, the petitioner approaches the respondent no. 5 by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be

The writ petition stands disposed off on the aforesaid terms.
