JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-03-2019 The petitioners seek bail in anticipation of their arrest in connection with Madanpur P.S. Case No. 17 of 2019, dated 23.01.2019, instituted for the offences under Sections 341, 323, 308 and 504/34 of the Indian Penal Code and Section 3/4 of the Prevention of Witch (Daain) Practices Act, 1999.

Though the allegation against the petitioners is of assaulting the informant and others, but the fact remains that both the parties are agnates and because of such relationship between them, the informant has chosen not to prosecute the petitioners. No injury report is stated to be on record.

Considering the aforesaid facts and the background of the petitioners as well as the informant, the petitioners above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present
