2. This is the second attempt on behalf of the petitioners for grant of bail in connection with Dhanaha P.S. Case No. 143 of 2023 registered for the offence punishable under Sections 363, 366A/34 of the Indian Penal Code and Section 8 of the POCSO Act.

3. Earlier the bail application of the petitioners has been rejected vide order dated 20.07.2024 passed in Cr. Misc. No. 77972 of 2023.

4. The petitioners are accused of committing rape

Patna High Court CR. MISC. No. 16415 of 2025(2) dt.02-05-2025 2/2 with a minor girl in Orchestra after purchasing her. Petitioners are in jail since 21.07.2023.

5. Learned counsel for the petitioners submits that both the victims have turned hostile in the trial.

6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Juge-7th-cum-Special Judge (POCSO), Bettiah, West Champaran/Successor Court in connection with Dhanaha P.S. Case No. 143 of 2023.

7. As a condition of this order, the petitioners, after being released on bail are directed to co-operate in the trial either by appearing personally or through their lawyer in the trial Court on each and every date fixed by the trial Court. Noncompliance of the condition will result in cancellation of the bail bonds of the petitioners.
