JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-10-2023 The short payer made by the petitioner in the present writ petition is to direct the Circle Officer, Mohania, Kaimur, to dispose off the pending encroachment case no. 2 of 2019. 2.

The learned counsel for the Respondent-State submits that in case, the aforesaid encroachment proceedings are still pending, the same would definitely be disposed off within a fixed time frame.

Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the Circle officer, Mohania, Kaimur, to dispose off the aforesaid encroachment proceeding, in case the same has not already been disposed off, by passing the final order under Section 6(1) of the Bihar Public Land

Patna High Court CWJC No.3798 of 2023(2) dt.09-10-2023 2/2 Encroachment Act, 1956, after hearing the affected parties and in accordance with law, within a period of eight weeks of receipt / production of a copy of this order.

The present writ petition stands disposed off on the aforesaid terms.
