====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 19-03-2025 Heard the learned counsel for the petitioner and the learned APP for the State.

2. The petitioner seeks regular bail in connection with Roh P.S. case no. 177 of 2024, dated 18.06.2024, instituted for the offences punishable under Sections 419, 420, 467, 468, 471, 120(B)/34 of the Indian Penal Code and Sections 66(C) 66(D) of the Information Technology Act.

3. The prosecution case, as per the First Information Report,, is that on 17.06.2024 in the evening, the police got secret information that petitioner along with other co-accused persons are scamming decoying people on phone by false assurance of jobs, reached at the place of occurrence. On seeing the police party, they started fleeing away, however one person

Patna High Court CR. MISC. No.18010 of 2025(2) dt.19-03-2025 2/3 namely Pawan Kumar was apprehended and others succeeded in fleeing away. Upon inquiry, the arrested co-accused disclosed the name of the petitioner and others.

4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case on the disclosure of his name by the arrested co-accused. The coaccused Pawan Kumar who was arrested on the spot has been granted regular bail by this Court vide order dated 18.10.2024, passed in Cr. Misc. No. 59215 of 2024. He further submits that during investigation, no cogent material has come against the petitioner in order to connect him with the present case. The petitioner is having one criminal antecedent of similar nature of offence and he is in custody since 26.10.2024. He also submits that charge-sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence.

Regard being had to the submissions made on behalf of the parties and taking into consideration the fact that petitioner is in custody since 26.10.2024, charge-sheet has already been submitted and similarly situated co-accused person who was arrested on the spot, has been granted bail by this Court, I deem it fit and appropriate to admit the petitioner to the

6. Accordingly, the above named petitioner is directed to be released on regular bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned court of Judicial Magistrate, 1st Class, Nawada in connection with Roh P.S. case no. 177 of 2024.
