JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 448, 341, 307 of the Indian Penal Code and Section 27 of the Arms Act.
Petitioner is said to have opened fire on the informant causing injury on her thumb for which petitioner is in jail custody since 12.02.2016. Annexure-2 to this petition is formal first information report of Hasanpur P.S. Case No. 35 of 2015 which had been lodged by the petitioner's mother against the father of informant of the present case and others. The aforesaid fact goes to show that there was serious litigating terms between the parties. Moreover, the investigation of this case has already
Patna High Court Cr.Misc. No.20390 of 2016 (2) dt.09-05-2016 2/2 been completed against the petitioner.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Samastipur in connection with Sessions Trial No. 263 of 2016 arising out of Hasanpur P.S.
